Privacy and Confidentiality
Privacy Policy — Moqshar Living
1. Introduction
Welcome to Moqshar Living. This Privacy Policy explains how personal and health information is collected, stored, used, and disclosed in line with the Privacy Act 1988 (Cth), the Australian Privacy Principles (APPs), and the ethical guidelines of the Australian Counselling Association (ACA).
2. Information we collect
To provide counselling safely and effectively, we may collect:
Personal details: full name, date of birth, address, email, and phone numbers
Emergency contact: name, relationship, and phone number of a nominated contact
Health and clinical information: relevant medical and mental health history, session notes, and assessments
Administrative and financial records: appointments, billing, payment history, and related correspondence
3. How information is collected
Information is usually collected directly from you through:
Enquiries (website form, email, or phone)
Intake forms, questionnaires, and counselling agreements
Notes and observations during sessions
4. Purpose of collection and use
Your information is collected to provide professional counselling services. That includes:
Assessing needs and delivering counselling support
Coordinating referrals or other care when you ask us to
Managing appointments, invoicing, and billing
Meeting professional, legal, and regulatory obligations
5. Confidentiality and limits
As an ACA-registered counsellor, Len Turner keeps session details and records confidential. Information is not shared without your consent, except where required or permitted by law or professional ethics, including:
Risk of harm: serious and imminent risk of harm to you or another person
Legal requirement: court order, subpoena, or other lawful demand
Child protection: disclosure or reasonable suspicion of harm, abuse, or neglect involving a child or young person
Supervision: clinical material may be discussed in a de-identified way with a qualified supervisor for professional accountability
6. Storage, security, and retention
We take practical steps to keep your information secure:
Digital records: password-protected systems and encrypted storage appropriate to a solo practice
Physical records: any paper notes kept in locked storage accessible only to the practitioner
Retention: records are kept for at least seven (7) years after last contact for adults, or until a client turns 25 where they were under 18 — or longer if insurance, law, or professional standards require — then securely destroyed
7. Accessing and correcting your information
You can request access to, or correction of, personal and clinical information held about you. Please put requests in writing to the contact details below. In rare cases where full access may cause serious harm or breach another person’s confidentiality, we may discuss an alternative (such as a summary) with you.
8. Website and digital tracking
The website may use basic analytics and, if enabled, advertising/measurement tools (for example Meta pixels) to understand traffic and improve the site. These tools can collect technical or aggregated browser data. You can limit tracking through your browser settings. Marketing tracking is separate from your clinical file.
